Terms and Conditions for the Prepaid cards(the “Prepaid cards”) promotion on Kinguin.net. („T&C”)

1. These T&C define the rules for participation in an online promotion “Prepaid cards” (the "Promotion").
2. The Promotion is available in the following countries: Poland, Germany, and The United States of America.
3. The Promotion is organized by Kinguin Digital Limited with its registered seat in 8/F On Hing Building 1 On Hing Terrace, Central Hong Kong ("Kinguin").
4. The Promotion shall start on July 22nd, 2022 at 12:00 CET and shall terminate on July 31th, 2021 at 23:59 CET (the “Promotion Period”).
5. The Promotion is not open to employees and contractors of Kinguin or Kinguin’s associated entities’ employees and contractors or members of their families, which include spouses, grandparents, parents, children and grandchildren, whether by marriage, past marriages or adoption or other family extensions.
6. During the Promotion, every user from Poland, Germany and the United States of America (the “Participant”) who makes a purchase on kinguin.net of one of the following products:

(„the Products”), will not pay service fees.

7. The Participant cannot be the person indicated in point 5 of these T&C. The opportunity to participate in the Promotion is personal and non-transferable. To the fullest extent permitted by law, Kinguin shall not be liable for any third party's performance or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the Promotion.
8. Kinguin reserves the right to suspend, change or cancel this Promotion at any time if circumstances arise outside of its control.
9. Kinguin shall have the right, at its sole discretion and at any time, to change or modify these T&C, such change shall be effective immediately upon posting on kinguin.net („the Website”).
10. In relation to the Promotion Kinguin is a personal data controller (the “Controller”). The processing is carried out in accordance with the provisions of applicable law regarding data protection.
11. The scope and all necessary information regarding Personal Data is described in detail on the following website: https://www.kinguin.net/privacy-policy-cookie-restriction-mode.
12. Providing personal data is voluntary but it is also a requirement necessary to enter into the Promotion.
13. Each Participant has the right to request access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing or to raise an objection before applicable authorities in relation to such processing.
14. When deciding to take a part in the Promotion, the Participant agrees to these T&C and undertakes to comply with their provisions.
15. Kinguin reserves the right to amend these T&C, provided that this will not result in a reduction of the rights of the Participants, if:

– such an amendment is necessary to remove obvious errors or mistakes in the text of the T&C, or

– to adapt the T&C to applicable laws, or

– if the need for the amendment arises from circumstances beyond the control of Kinguin, which occurred after the publication of the T&C and which Kinguin could not have foreseen. Kinguin will inform about amendments to the T&C on the Website.

16. These T&C are governed by the laws of Hong Kong. Any disputes shall be brought in the courts of Hong Kong. In matters not regulated by the provisions of the T&C, the commonly binding provisions of law will apply.
