Terms and Conditions for the “Kinguin Star Wars Cosplay Competition”
1. These terms and conditions define the rules for participation in an online contest (the "Contest") run worldwide through on social media, link to the post: https://www.facebook.com/Kinguin.net/posts/pfbid0XaPZDii9vLZqMhpQoPZ2K2axMmp6wjUziNXXuaxvyY2LuENhyiyy4dwzkwqSZbhDl (“Social Media”)
2. The Contest is organised by Kinguin Digital Limited with its registered seat in 8/F On Hing Building 1 On Hing Terrace, Central Hong Kong ("Kinguin").
3. The Contest shall start on 04.05.2023. at 15:00 CET, till 11.05.2023. at 23:59 will end the phase of photo submissions. From 12.05.2023. at 12:00 CET will start the phase of voting and shall terminate on 14.05.2023. at 23:59 CET (the “Contest Termination Date”), (the “Contest Period”).
4. The Organizer is the founder and issuer of the Prizes in the Contest.
5. Each participant of the Contest (the "Participant") must be at least 18 years old or the age of majority in the province, territory or country where the Participant has their habitual place of residence.
6.The Contest is not open to employees of Kinguin or Kinguin’s associated entities’ employees or members of their families, which include spouses, grandparents, parents, children and grandchildren, whether by marriage, past marriages or adoption or other family extensions.
7. By entering the Contest, the Participant confirms that he/she agrees with the rules described herein.
8. To be eligible to win the prize:
1st place: STAR WARS Jedi Survivor Origin CD Key and Kinguin EUR100 Gift Card
2nd place: STAR WARS Jedi Survivor Origin CD Key and Kinguin EUR50 Gift Card
3rd place: STAR WARS Jedi Survivor Origin CD Key and Kinguin EUR25 Gift Card
(the ‘’Prize’’) the Participant needs to:
a) post a photo in the costume related to Star Wars - in a comment under the contest announcement post - with the tag #kinguinjedi in the comment under the photo or in the post.
9. By participating in the Contest, the Participant declares that the Participant is the sole creator of the creative material accompanying the entry (the "Work”) and that the Participant is entitled to copyrights to the Work with any permissions required for its distribution.
10. By entering the Contest, the Participant grants Kinguin a royalty-free, non-exclusive licence to use the Work, including but not limited to reproducing, sub-licensing, circulating, and distributing in perpetuity, without territorial or quantitative limitations.
11. If it is determined that a violation of the rules described in these Terms and Conditions has occurred, the Organizer will be entitled to exclude the Participant from the Contest with immediate effect.
12. Within 14 (fourteen) days after the Contest Termination Date, a jury consisting of three (3) Kinguin’s employees of Kinguin’s choice (the “Jury”) shall proclaim three (3) winners of the Prize (the “Winner”). The Jury shall be the only one empowered to choose the Winner of the Contest.
13. The Prizes shall be distributed among top 3 Winners, in accordance with the point 8 of these Terms & Conditions.
The first step to win the Prize is to get as many likes (votes) as possible under the Participant comment of contest announcement post - with the tag #kinguinjedi. The photo with the highest number of likes (votes) will be judged by the Jury. Top 5 (five) most voted photos will be reviewed by the Jury, and then, top 3 (three) Winners will be chosen. The criterion that the Jury will use when selecting the Winner:
1) Creativity in execution and use of materials
2) Method of execution
3) Overall aesthetic of the costume
4)Presentation method
The Jury reserves the right not to challenge its choice of the Winner.
14. The Prizes shall be funded by Kinguin.
15. The Prize cannot be exchanged for the equivalent in cash, or prizes of another kind.
16. The Winners will be announced through Kinguin’s social media posts on facebook within 14 days from the Contest Termination Date.
17. The prize will be delivered to the Winner e-mail within 7 days from the Contest Termination Date.
18. When it is discovered that the Winner is a person who does not meet the
conditions specified in these Terms and Conditions, the Participant, who have won the Contest, shall be denied the right to the Prize. In the case of disclosure of this fact after receival of the Prize, the Participant will be obliged to return the Prize and will bear any costs incurred in relation with such a return.
19. Kinguin reserves the right to remove a Participant from the Contest, in case of a doubt as to the veracity of his/her profile or in case of any breach by the Participant of these Terms and Conditions or any rights of third parties.
20. To the fullest extent permitted by law, Kinguin shall not be liable for any third party's performance or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the Contest.
21. In relation to the Contest Kinguin is a personal data controller (the “Controller”). Personal data of Participants is processed in order to:
a) allow the participation in the Contest;
b) verify if the Participant meets the requirements of the Contest;
c) communicate with the Participant;
d) deliver the Contest Prize or the Daily Prize to the Participant;
e) for the marketing purposes of the Controller, as well as in connection with the legitimate interest pursued by the Controller, namely marketing of its own products and services.
21. Personal data will be processed by the Controller during the implementation of the above goals. Providing such personal data is voluntary but it is also a requirement necessary to enter into the Contest. The personal data will not be processed in an automated way.
23. Each Participant has the right to request the access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing or to raise an objection before applicable authorities in relation to such processing.
24.Unless stated otherwise in the relevant regulation or laws each Winner is solely responsible for reporting and paying any and all applicable taxes related to the Contest Prize.
25. These Terms & Conditions are governed by the laws of Hong Kong. However, the foregoing will be without prejudice to mandatory laws, which in the absence of a choice of law would have been applicable based on the consumer’s habitual residence in the EU, provided that such laws cannot be contractually derogated from by virtue of the law.
